Hi friends,
The abuse and mis-use of ex-parte applications became rampant and scandalous at a time, that this legal avenue got a bad name and it appeared that a ban was imposed on judges not to consider applications for injunctions brought ex-parte, no matter how meritorious.
This attitude sparked controversy in the legal profession as many contend that jettisoning or forbidding ex-parte applications completely will create untold and irredeemable hardship and loss to people in certain circumstances.
However as our cover-story this week will show, a lot of wickedness and unjust consequences can arise when ex-parte applications are achieved in some circumstances. Such circumstances involved Mr. Bisi Ade-Ademuwagun, a Doctor of Divinity and Former Chairman of the famous Ikeja Branch of the Nigeria Bar Association.
All together it is a curious, sad and bewildering story of how a Fundamental Right protection action transformed half –way into a land-possession tool and the depriver of other people’s liberty, all in the hands Bisi Ade-Ademuwagun Esq. an otherwise respectable leader of the Nigerian bar.

High Court Igbosere was agog with rather strange, even bizarre news that the Judiciary’s Resource Centre located at the Old Senate Building at the Tafawa Balewa Square was home to native fetish rituals of palm-oil and “akara” balls last week Monday. To make it more intriguing, the stories had it that the perpetrator of the fetish practice was none other than Honourable Justice W.A.E Ayo, the head of the Resources Centre.

We have three contributors this week. The first, rather surprisingly is our Mr. Olusegun Adara, the Chief of Production. This piece entitled: The Case of the Fighting Judge, is to say the least thought provoking.
The second contributor - ‘Professor’ Ademola Adewale needs no introduction to regular Squibbers. The chronic writer sent in two articles, the first is entitled “Amaechi v. Omehia - Another Land Mark Decision” while the second is entitled “The Waiting Game.” As usual they are not only informative but educative.
The third contributor is Olawale Akoni, Esq. S.A.N. The silk presented a paper titled: “A CRITICAL APPRAISAL OF THE LAGOS STATE MAGISTRCY; CHALLENGES & CONSTRAINTS OF MAGISTRATES IN THE ADMINISTRATION OF JUSTICE” at the “One –Day stake holders summit” organized by the Lagos State Ministry of Justice, with the Theme of “Magistracy & Justice Sector Reform” An Appraisal of the First level of Justice in Lagos State.
The summit took place on Wednesday 13th November 2007. The silk’s paper came to us and is hereby presented to the “whole world” in this edition.

Last week, we broke the sad news of a judge who assaulted her judicial assistant. This week we do a follow-up on the ugly incident. It is our cover story. Presented as usual in our blunt, factual style, it is another unputdownable read which exposes efforts by the authorities (the Lagos Judiciary) to sweep the matter under the carpet.
We have a guest in the house today, in person of Chief Adetunji Orisalade. The veteran advocate’s piece is entitled “Mistake, Negligence or Inadvertence of Counsel: An Almighty Exculpator?” Quite an educative and exhortative piece, our readers, we are sure, will find it. Another guest is Barrister Adejare Kembi who sent us a copy of his reaction to the reply of Senior Magistrate Awope to his (Kembi’s) petition against the magistrate to the Public Complaint and Training Committee of the Lagos State Judiciary. For a better appreciation of Kembi’s letter, readers are advised to pick up the Vol. 8 No 3 edition of the Squib of 8th October 2007. That edition has both Kembi’s petition and Magistrate Awope’s reply.
